Terms of Use

These Terms of Use ("Terms") are an agreement between you and Rewire Performance Physical Therapy ("Rewire", "we", "us") governing your use of the Rewire Performance mobile application and related services (collectively, the "App"). By downloading, installing, or using the App, you agree to these Terms. If you do not agree, do not use the App.

1. Eligibility

You must be at least 13 years old to create your own account. If you are under 13 (or the minimum age in your jurisdiction), a parent or legal guardian must create and manage the account on your behalf and agree to these Terms.

2. Your Account

• You are responsible for keeping your login credentials confidential.
• You are responsible for all activity that happens under your account.
• You agree to provide accurate registration information and keep it up to date.
• One person per account. Do not share or transfer your account.

3. Health, Safety, and Fitness Disclaimer

Rewire Performance provides strength and conditioning programming intended for healthy athletes. It is not medical advice and is not a substitute for evaluation, diagnosis, or treatment by a licensed healthcare professional. By using the App, you acknowledge that:

• Strength training and physical exercise carry inherent risk of injury.
• You should consult a physician before beginning any exercise program, especially if you have any pre-existing medical conditions.
• You assume full responsibility for your own safety while performing any exercise shown or described in the App.
• You should stop any exercise immediately and seek medical attention if you experience pain, dizziness, or other warning signs.

4. Acceptable Use

You agree not to:

• Use the App in any unlawful or harmful manner.
• Attempt to gain unauthorized access to any account, server, or system associated with the App.
• Reverse-engineer, decompile, or attempt to extract source code from the App, except where permitted by law.
• Upload content that is illegal, infringing, harassing, sexually explicit, or that violates another person's privacy.
• Use the App to send spam or unsolicited messages to coaches or other users.
• Misrepresent your identity, including impersonating a coach, administrator, or other user.

5. User-Generated Content

You retain ownership of any content you upload to the App (photos, videos, journal entries, messages). By uploading content, you grant Rewire a limited, non-exclusive, royalty-free license to store, display, and process that content solely for the purpose of providing the App to you and your coach.

You are responsible for the content you upload. Do not upload anything you do not have the right to share.

6. Subscriptions and Payments

The current release of the App is free. If we introduce paid subscriptions or in-app purchases in the future, all transactions will be processed by Apple (App Store) or Google (Play Store) under their respective payment terms. Subscription renewals, cancellations, and refunds are governed by the store you purchased from.

7. Intellectual Property

The App, including its design, workouts, programming, video content, branding, and underlying software, is owned by Rewire Performance Physical Therapy and is protected by intellectual property laws. We grant you a personal, non-transferable, revocable license to use the App for your own training. You may not redistribute, resell, or publish the App's content without our written permission.

8. Termination

We may suspend or terminate your account if you violate these Terms or use the App in a way that harms other users. You may delete your account at any time via the Account Deletion page.

9. Disclaimer of Warranties

The App is provided "as is" and "as available" without warranties of any kind, express or implied, including warranties of merchantability, fitness for a particular purpose, or non-infringement. We do not warrant that the App will be uninterrupted, error-free, or free of harmful components.

10. Limitation of Liability

To the maximum extent permitted by law, Rewire Performance Physical Therapy and its officers, employees, and service providers will not be liable for any indirect, incidental, consequential, special, or punitive damages, or for any loss of profits, data, or goodwill, arising out of or related to your use of the App.

Some jurisdictions do not allow limitations of liability for certain types of damages, so the limitations above may not apply to you.

11. Indemnification

You agree to indemnify and hold Rewire harmless from any claims, damages, or expenses (including reasonable attorneys' fees) arising from your misuse of the App, your violation of these Terms, or your violation of any third-party rights.

12. Governing Law

These Terms are governed by the laws of the State of Florida, USA, without regard to its conflict-of-laws principles. Any dispute will be resolved in the state or federal courts located in Florida.

13. Changes to These Terms

We may update these Terms from time to time. We will update the "Last Updated" date above and, where the changes are material, notify you in-app. Continued use of the App after changes take effect constitutes acceptance of the new Terms.
